Staying informed on legislative developments is an important part of running a successful contracting business. A newly introduced bill in the South Carolina General Assembly could change how HVAC manufacturer warranties are handled when residential properties change ownership, potentially affecting contractors, manufacturers, real estate professionals, and homeowners alike.
While House Bill 5007 has not yet become law, it is worth keeping on your radar. If enacted, the legislation would establish new requirements for the transferability of residential HVAC warranties, creating a more consistent experience for homeowners while reducing some of the warranty challenges contractors encounter after a home sale.
Here’s what SCALT members should know:
- Manufacturer warranties on qualifying residential HVAC systems would automatically transfer to a new homeowner when the property is sold.
- Manufacturers could not charge a fee to transfer a warranty.
- Warranty coverage could not be denied simply because the equipment was not registered after installation.
- The bill would apply to qualifying residential property sales occurring after June 30, 2026, if passed into law.
Although the legislation is still moving through the General Assembly, HVAC contractors should monitor its progress. Changes to warranty requirements could influence customer expectations, manufacturer policies, and post-sale service conversations.
